Pomela (“Pomela”, “we”, “us”) is a software platform that enables dynamic headline personalization based on search intent and advertising data (the “Service”). By accessing or using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
The Service enables users to connect advertising accounts (including Google Ads), import campaign structure such as campaigns, ad groups, and keywords, generate and manage headline variations, and dynamically display headlines on landing pages. The Service modifies only specific, user-defined elements (such as headlines) and does not change page layout or structure unless explicitly configured by the user.
If you connect a Google Ads account, Pomela accesses Google Ads data only after you authorize access via Google OAuth. You represent and warrant that you have all necessary rights and permissions to connect any advertising account and to grant Pomela access to the related data. You are responsible for ensuring that your use of the Service complies with applicable laws and the policies of any integrated platform.
Pomela uses authorized advertising data solely to provide the Service functionality (including matching headlines to intent, personalization, reporting, and performance optimization features). Pomela does not sell your advertising data. You remain fully responsible for (a) all content shown on your landing pages, (b) the accuracy and legality of any headlines and claims, and (c) how personalization is applied within your campaigns.
The Service is provided as an optimization tool and does not guarantee improvements in conversion rate, Quality Score, cost per click, revenue, or advertising performance. Results depend on many factors outside Pomela’s control, including traffic quality, offer, creative, pricing, competition, and market conditions.
Third-party services. The Service may integrate with third-party platforms (including Google Ads). Third-party platforms operate independently, and may change their APIs, features, or policies at any time. Pomela is not responsible for third-party outages, API changes, limitations imposed by third parties, or enforcement actions taken by third parties, including account suspensions or restrictions.
Acceptable use. You agree not to misuse the Service, attempt to access accounts or data without authorization, interfere with the Service, or use the Service in a way that violates any applicable law or third-party policy. We may suspend or terminate access to the Service if we reasonably believe your use creates risk, violates these Terms, or violates third-party policies.
Updates to the Service and Terms. We may modify the Service and update these Terms from time to time. Continued use of the Service after an update becomes effective constitutes acceptance of the updated Terms.
Limitation of liability. To the maximum extent permitted by law, Pomela will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, including loss of advertising spend. Pomela’s total liability for any claim arising out of or relating to the Service will not exceed the amount paid by you to Pomela for the Service during the three (3) months preceding the event giving rise to the claim.
Governing law. These Terms are governed by the laws of the State of Israel, without regard to conflict of laws principles.
